CUSTOMER/USER PRIVACY POLICY

Information about you is being sent to GoMoto Philippines (“GoMoto”) through the use of your mobile application/software supplied by GoMoto, or through any other means of communicating with GoMoto.
SCOPE AND APPLICATION
This User Privacy Policy (“Policy”) is made applicable to those who uses the GoMoto Application/Software to request for transportation, delivery, or other on-demand services. Also, a separate Privacy Policy applies to drivers, couriers, transporters, vehicle operators, and any other person that use the GoMoto Application/Software. If you interact with the Services as both a Customer/User and a Driver, the respective Privacy Policy apply to your different interactions.
COLLECTION OF INFORMATION
INFORMATION YOU PROVIDE TO US
Information you provide directly to GoMoto, such as when you create or modify your account, request on-demand services through the use of GoMoto Application/Software, contact customer support, or communicate with GoMoto in any manner, are being collected. This information may include personal data such as your name, email, phone number, postal address and other information that you may provide.
INFORMATION WE COLLECT THROUGH YOUR USE OF OUR SERVICES
When you use the GoMoto Application/Software, information about you, in the following categories, are collected:
Location Information: When you use the Services for transportation or delivery, precise location data about the trip from the GoMoto Application/Software used by the driver are being collected. If you permit the GoMoto Application to access location services (see for your settings in your mobile device), GoMoto may also collect the precise location of your device when the Application is running in the foreground or background. GoMoto may also derive your approximate location from your IP address.
Contacts Information: If you permit the GoMoto app to access the address book on your device, GoMoto may access and store names and contact information from your address book to facilitate social interactions through GoMoto’s Services, and for other purposes described in this Policy or at the time of consent or collection.
Transaction Information: GoMoto collects transaction details in connection with your use of the GoMoto Application, including the nature of service requested, date and time the service was provided, amount charged, distance traveled, and other related transaction details.
Usage and Preference Information: GoMoto collects information about how you and site visitors interact with GoMoto’s Services, preferences expressed, and settings chosen. In some cases, GoMoto does this through the use of cookies, pixel tags, and similar technologies that create and maintain unique identifiers.
Device Information: GoMoto may also collect information about your mobile device, including the model, operating system and version, software and file names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.
Call and SMS Data: GoMoto’s Services facilitate communications between Customer/Users and Drivers. In connection with facilitating this service, GoMoto receives call data, including the date and time of the call or SMS message, the parties’ phone numbers, and the even the content of the SMS message.
Log Information: When you interact with GoMoto’s Services, server logs are collected, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service you were using before interacting with GoMoto’s Services.
IMPORTANT INFORMATION ABOUT PLATFORM PERMISSIONS
Most mobile platforms have defined certain types of device data that apps cannot access without your consent. And these platforms have different permission systems for obtaining your consent. Sometimes these permission systems require more explanation than the platforms themselves provide, and the permissions GoMoto requests will change over time.
INFORMATION COLLECTED FROM OTHER SOURCES
GoMoto may also receive information from other sources and combine that with the information we collected through GoMoto’s Services.
USE OF INFORMATION
GoMoto may use the information collect about you for the following purposes:
- Provide, maintain, and improve our Services, including, facilitation of payments, sending of receipts, providing products and services that you may request, development of new features, providing customer support to Customer/Users and Drivers, development of safety features, authentication of users, and sending product updates and administrative messages.
- Performing internal operations, including prevention of fraud and abuse of GoMoto’s Services, troubleshooting software bugs and operational problems, conducting data analysis, testing, and research; and in monitoring and analyzing usage and activity trends.
- Sending or facilitating communications between you and a Driver, or between you and your contact at your direction, in connection with your use of certain features.
- Sending to you of communications that GoMoto thinks will be of interest to you, including information about products, services, promotions, news, and events of GoMoto and other companies, where permissible and according to local applicable laws, and to process contest, sweepstake, or other promotion entries and fulfill any related awards;
- Personalization and improvement of the Services, which includes providing, or recommending features, content, social connections, referrals, and advertisements.
SHARING OF INFORMATION
GoMoto may share collected information about you as described in this Policy or as described at the time of collection or sharing, including as follows:
Through the GoMoto Services. Information may be shared with the following:
- To enable them to provide the Services you request.
- With third parties. To provide you a service you requested through a partnership or promotional offering made by a third party.
- With the general public. If you submit content in a public forum, such as blog comments, social media posts, or other features of GoMoto’s Services that are viewable by the general public.
- With third parties with whom you choose to let us share information.
OTHER IMPORTANT SHARING
We may share your information:
- With GoMoto subsidiaries and affiliated entities. Those providing services or conduct data processing on GoMoto’s behalf, or for data centralization and/or logistics purposes.
- With vendors, consultants, marketing partners. And to other service providers who need access to such information to carry out work on GoMoto’s behalf.
- With the authorities. In response to a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process.
- With law enforcement officials or other third parties. If we believe your actions are inconsistent with the user agreements, Terms of Service, or policies, or to protect the rights, property, or safety of GoMoto or others;
- With appropriate parties. In connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of GoMoto’s business by or into another company;
Sharing also takes place if GoMoto notifies you and you consent to the sharing; and in an aggregated and/or anonymized form, which cannot reasonably be used to identify you.
SOCIAL SHARING FEATURES
The Services may integrate with social sharing features and other related tools which let you share actions you take on our Services with other apps, sites, or media, and vice versa. Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the social sharing service. Please refer to the privacy policies of those social sharing services for more information about how they handle the data you provide to or share through them.
YOUR CHOICES
Account Information. You may correct your account information at any time by logging into your account. Please note that in some cases, GoMoto may retain certain information about you as required by law, or for legitimate business purposes to the extent permitted by law.
Access Rights. GoMoto will comply with individual’s requests regarding access, correction, and/or deletion of the personal data it stores in accordance with applicable law.
CONTACT INFORMATION
GoMoto may also seek permission for our Application’s collection and syncing of contact information from your device.
PROMOTIONAL COMMUNICATIONS
You may opt out of receiving promotional messages from GoMoto by following the instructions in those messages. If you opt out, GoMoto may still send you non-promotional communications, such as those about your account, about the Services you have requested, or our ongoing business relations.
CHANGES TO THE STATEMENT
GoMoto may change this Privacy Policy from time to time. If significant changes are made in the way GoMoto treats your personal information, or to the Policy, GoMoto will provide you notice through the Services or by some other means, such as email. Your continued use of the Services after such notice constitutes your consent to the changes. GoMoto encourages you to periodically review this Privacy Policy for the latest information on our privacy practices.
DRIVER PRIVACY POLICY
Effective Date: March 21, 2016
Information about you is being sent to GoMoto Philippines (“GoMoto”) through the use of your mobile application/software supplied by GoMoto, or through any other means of communicating with GoMoto.
SCOPE AND APPLICATION
This Driver Privacy Policy (“Policy”) is made applicable to drivers, couriers, transporters, vehicle operators, and any other person that use the GoMoto Application/Software in Territorial Operation of the GoMoto Platform. Also, a separate Policy applies to persons who, instead of driving, uses our Application to request for transportation, delivery, or other on-demand services. If you interact with the Services as both a User and a Driver, the respective privacy policy apply to your different interactions.
COLLECTION OF INFORMATION
GoMoto may collect personal data from you during the course of your application for, and use of, the GoMoto Services, including location data, which information may be stored, processed, and/or accessed by GoMoto, as well as its service providers, for business purposes, including for marketing, lead generation, service development and improvement, analytics, industry and market research, and such other purposes consistent with GoMoto’s and its Affiliates’ legitimate business needs. By giving information to GoMoto during the application process and/or by using the Services, it is understood that you consent to such collection and use of personal data about you.
DISCLOSURE OF DRIVER INFORMATION TO THIRD PARTIES
Subject to the provisions of existing laws, GoMoto may provide to a third party any information (including personal data)that may have been collected, about drivers provided hereunder in any of the following instances:
- If there is a complaint, dispute or conflict, including an incident and/or accident, concerning a driver who uses the GoMoto Application/Software;
- If the giving out of such personal information is necessary to enforce the Terms and Conditions agreed upon with the driver;
- If the giving out of such personal information is required by law, rules and regulations, local ordinances, license agreements, contract;
- If, based on GoMoto’s discretion, the giving out of such personal information is necessary to protect the safety, rights, property, or security of GoMoto, its services, or of any third party;
- If, based on GoMoto’s discretion, the giving out of such personal information is necessary to detect, prevent or otherwise address fraud, security or technical issues;
- If, based on GoMoto’s discretion, the giving out of such personal information is necessary to prevent or stop any activity, which is considered to be illegal, unethical, or legally actionable, or is a threat to pose a risk of being illegal, unethical, or legally actionable.
CONSENTING TO THE USE OF LOCATION-BASED SERVICES
By using the GoMoto Application/Software, you are hereby giving your express consent to GoMoto’s use of location-based services, and that you are expressly waiving and releasing GoMoto from any and all liability, claims, causes of action or damages arising from your use of the GoMoto Services.
By acknowledging, I declare that:
I have fully understood and hereby accepts all the provisions stated, and I will be solely responsible for any and all liability(ies), which may result or has allegedly resulted in the course of the operation of my vehicle rendering services.
I have understood and hereby agrees that GoMoto has the right to take appropriate actions against me, including suspending or terminating my partnership in the event that I commit breach of any of the provisions of this Privacy Policy.
